Case Ops, Not Case Management, Is the PI Bottleneck
The real bottleneck in a personal injury firm is case ops: chasing records, tracking treatment, and moving cases to demand. Why managing cases is not the same as running them.
The bottleneck in a personal injury firm is not managing cases. It is running them. Managing means knowing where a case stands. Running means moving it: chasing the medical records, tracking treatment, assembling the demand, keeping the client warm, and doing all of that across a hundred cases at once without anything falling through. Most software helps you manage. Almost none of it helps you run. That gap is where PI firms leak time and money.
I build software for this, and I think the industry has the vocabulary wrong. "Case management" describes a filing system. What firms actually need is case operations.
What is the difference between managing and running a case?
Managing a case is passive. Your software shows you a list of cases, their statuses, their next dates. You look at it, and you feel informed. Nothing has moved.
Running a case is active. Something has to draft the records request, send it, follow up when the provider ignores it, notice when treatment stalls, calculate the demand when the bills are in, and nudge the client who went quiet. In most firms, a person does every one of those things by hand, one case at a time, from memory. That person is the bottleneck. Not because they are slow, but because the work is enormous and the software does none of it.
This is the same distinction I keep drawing between storage and action. A tool that records your cases is a filing cabinet. A tool that advances them is an operations engine, and that is what AI-native software is supposed to be, as I argued in AI-native case management for PI law.
Where does case ops actually break down?
In the same three places, every firm.
Records retrieval. Medical providers are slow and unresponsive. Chasing them is tedious, repetitive, and easy to drop when the person doing it is busy. Cases sit for weeks waiting on records nobody followed up on.
Treatment tracking. A client stops going to physical therapy and nobody notices for a month. The case weakens and the firm finds out too late.
Demand assembly. When the bills and records finally arrive, someone has to pull it all together. That step queues behind everything else and cases age while they wait.
None of these are legal problems. They are operations problems. And operations problems compound: every stalled case is capital sitting idle, and in a contingency business idle capital is the whole ballgame.
Why doesn't case management software fix this?
Because it was built to record, not to run. Most tools in this category, especially general-practice ones, assume a human drives every action and the software just remembers it. That assumption made sense before AI could do the driving. It does not anymore.
The reason so much software stops at management is that adding a database field is easy and building a system that takes action is hard. Bolted-on AI does not fix it either, because a chatbot stapled to a filing cabinet is still a filing cabinet. What does real case ops look like?
Software that runs cases does the operational work and escalates the judgment. In practice:
- It drafts and sends records requests, then chases the providers that go silent.
- It watches treatment and flags a case the moment it stalls.
- It assembles the demand as the pieces arrive instead of waiting for a human to start.
- It surfaces aging cases so nothing rots quietly in the pipeline.
Your staff stops being the bottleneck and starts doing the work that needs a person: judgment, negotiation, client relationships. The machine handles the logistics. Your firm is not slow because your people are slow. It is slow because they are hand-carrying operational work that software should do, and the software you have only helps you watch it pile up. Stop buying tools that manage cases. Buy the one that runs them.
